127 SKIN operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the "Services"). 127 SKIN is powered by Shopify, which enables us to provide the Services to you.

These terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms"), describe your rights and responsibilities when you use the Services.

127 SKIN reserves the right to accept or decline an order, subject to applicable law.

An order is not accepted until payment has been successfully processed and we have confirmed the order.

Once an order has been processed or dispatched, we may be unable to accommodate a cancellation request, subject to any statutory cancellation or cooling-off rights available to you under South African law.

If we decline, cancel or materially change an order, we will attempt to contact you using the email address, phone number or billing information supplied when the order was placed.

Purchases are subject to our Returns, Refunds & Warranty Policy.

Products purchased through 127 SKIN are intended primarily for personal or household use unless otherwise agreed in writing.

The price charged for a product will be the price displayed at the time the order is placed, subject to correction of genuine pricing errors as permitted by law.

If promotional terms conflict with these Terms, the promotional terms will apply to that promotion, subject to applicable law.

Customers are responsible for providing complete and accurate delivery details.

If an order is delayed, lost or damaged while being transported by a courier appointed by us, please contact us so that the matter can be investigated and handled in accordance with applicable law.

Where an incorrect or incomplete delivery address is supplied by the customer, the customer may be responsible for reasonable additional delivery or redelivery costs where permitted by law.

The Services and their content, including but not limited to trademarks, logos, brand names, product names, text, photographs, graphics, videos, audio, designs, layouts and other materials, are owned by or licensed to 127 SKIN and/or DARE 2 DARE.

127 SKIN is powered by Shopify, which provides the ecommerce infrastructure used to operate our online store.

However, purchases made through our Store are made directly with 127 SKIN, operated by DARE 2 DARE.

Shopify is not the seller of 127 SKIN products.

Your contractual relationship regarding the purchase of 127 SKIN products is with DARE 2 DARE trading as or operating 127 SKIN, except where separate services are expressly provided by Shopify or another third party.

SECTION 10 - PRIVACY

Personal information collected through the Services is handled in accordance with our Privacy Policy and applicable South African privacy law.

Because our Store is hosted by Shopify, certain information may also be processed by Shopify and other service providers necessary to provide website hosting, payment processing, fulfilment, delivery, fraud prevention, analytics and customer support.

Information provided through our website, advertisements, social media, packaging or other materials should not be interpreted as medical advice.

Individual results may vary depending on factors including:

• Frequency of use

• Skincare products used
• Lifestyle
• Individual circumstances

We do not guarantee identical results for every customer.

Customers should follow all product instructions and safety guidance supplied with the product.

SECTION 17 - DISCLAIMER OF WARRANTIES

To the fullest extent permitted by law, we do not guarantee that:

• Products will meet subjective expectations not expressly represented by us

Nothing in these Terms excludes or limits any statutory warranty or consumer right that cannot legally be excluded under South African law, including applicable rights under the Consumer Protection Act 68 of 2008.

SECTION 18 - LIMITATION OF LIABILITY

To the fullest extent permitted under South African law, 127 SKIN and DARE 2 DARE will not be liable for indirect, incidental, special or consequential losses arising from use of the Services or products where such liability may lawfully be limited.

This may include loss of profits, revenue, data or similar indirect economic loss.

Nothing in these Terms limits liability where such limitation is prohibited by applicable law.

Nothing in these Terms limits or excludes a consumer's statutory rights under applicable South African consumer-protection legislation.

SECTION 19 - PRODUCT USE AND CUSTOMER RESPONSIBILITY

Customers must use 127 SKIN products in accordance with the instructions, warnings and intended purpose of the product.

To the fullest extent permitted by law, 127 SKIN will not be responsible for damage or injury arising from:

• Deliberate misuse
• Negligent use
• Unauthorised modification
• Use contrary to supplied instructions
• Use with incompatible accessories
• Improper charging
• Use of a damaged product after a safety concern becomes apparent

Customers should stop using a product if it becomes damaged, overheats, behaves abnormally or otherwise appears unsafe.

This section does not exclude liability which cannot lawfully be excluded.

SECTION 20 - RETURNS, REFUNDS AND WARRANTIES

Returns, refunds and warranty claims are governed by our Returns, Refunds & Warranty Policy.

127 SKIN currently offers a 15-day voluntary return period for eligible products, subject to the requirements set out in that policy.

The voluntary return period does not replace or restrict statutory consumer rights.

Where applicable, qualifying defective goods remain subject to statutory protections under South African law, including the Consumer Protection Act.

SECTION 21 - FRAUD, CHARGEBACKS AND FALSE CLAIMS

We encourage customers to contact us directly if there is a problem with an order.

Nothing in these Terms prevents customers from exercising legitimate rights through their bank, payment provider or applicable consumer-protection process.

We reserve the right to dispute fraudulent chargebacks, false claims or deliberate attempts to obtain both a refund and retain goods.

Where reasonably necessary, we may rely on order records, courier tracking, delivery confirmations, communications and other lawful evidence when investigating fraud or responding to a payment dispute.

SECTION 22 - INDEMNIFICATION

To the extent permitted by law, you agree to indemnify 127 SKIN and DARE 2 DARE against third-party claims arising directly from:

• Your material breach of these Terms
• Your unlawful use of the Services
• Your infringement of another person's rights
• Fraudulent or intentionally unlawful conduct by you

Nothing in this provision requires a consumer to indemnify us where doing so would be prohibited or unfair under South African law.

SECTION 23 - SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be enforced to the maximum extent legally permitted.

Any unenforceable portion will be severed and the remaining Terms will continue to apply.

SECTION 24 - WAIVER AND ENTIRE AGREEMENT

These Terms of Service and purchases made through 127 SKIN are governed by and interpreted in accordance with the laws of the Republic of South Africa.

Nothing in these Terms prevents a consumer from exercising rights available under applicable South African consumer-protection legislation.

Headings are included for convenience only and do not limit or affect the interpretation of these Terms.

SECTION 28 - CHANGES TO THESE TERMS

We may update these Terms from time to time to reflect changes to our business, Services, products or applicable law.

The most recent version will be made available through our website.

Where required by law, appropriate notice of material changes will be provided.

Changes will not retrospectively remove statutory rights acquired by customers under applicable law.
